(hereinafter - the company, the plaintiff) appealed to the Moscow Arbitration Court with a statement of claim to Tallinn LD Closed Joint-Stock Company (hereinafter - the defendant) to recover compensation in the amount of 150,000 rubles for violation of the exclusive right to the character of Tatty Teddy.
By a decision of the Moscow Arbitration Court of September 1, 2014, upheld by a decision of the Ninth Arbitration Court of Appeal of December 4, 2014, the claim was denied.
Disagreeing with the adopted judicial acts, the company appealed to the Intellectual Rights Court with a cassation appeal, in which it asks for a decision and order to cancel, satisfy the claims.
In support of the arguments of the complaint, the company refers to the unlawfulness of the court's conclusions about the inadmissibility of the affidavit presented by it in the case materials, indicating that this document contains a character image and was not contested by the defendant. According to the plaintiff, he proved that the exclusive right to the controversial character was owned, and therefore the claimed claim for the recovery of compensation must be satisfied.
The response to the cassation appeal by the defendant is not submitted.
At the hearing of the court of cassation, the representatives of the plaintiff supported the arguments of the complaint, asked to cancel the contested judicial acts and send the case for a new consideration.
The defendant, duly notified of the time and place of the hearing, did not send his representative to the court of cassation, which, in accordance with part 3 of the article of the Arbitration Procedure Code of the Russian Federation, is not an obstacle to the consideration of the cassation appeal in his absence.
Having discussed the arguments of the cassation appeal, after hearing the representatives of the plaintiff, checking, in accordance with the articles of the Arbitration Procedure Code of the Russian Federation, the correct application of substantive and procedural law by the courts, the compliance of the court findings with the evidence in the case and established factual circumstances, the Intellectual Property Court concluded that grounds for its satisfaction by virtue of the following.
In accordance with paragraph 1 of Article of the Civil Code of the Russian Federation (hereinafter - the Civil Code of the Russian Federation, the Code), a citizen or legal entity having the exclusive right to a result of intellectual activity or a means of individualization (copyright holder) is entitled to use such a result or such tool at its discretion by any in a manner contrary to law. The copyright holder may dispose of the exclusive right to the result of intellectual activity, unless otherwise provided by the Code.
The copyright holder may, at its discretion, authorize or prohibit other persons from using the result of intellectual activity or means of individualization. The absence of a ban is not considered consent.
Other persons cannot use the corresponding result of intellectual activity or means of individualization without the consent of the copyright holder, with the exception of cases provided for by the Code. The use of the result of intellectual activity or means of individualization (including their use by the methods provided for by the Code), if such use is carried out without the consent of the copyright holder, is illegal and entails liability established by the Code, other laws, except when the use of the result of intellectual activity or means individualization by persons other than the copyright holder, without his consent, is permitted by this Code.
Clause 1 of the article stipulates that the author of the work or other copyright holder has the exclusive right to use the work in accordance with article 1229 of this Code in any form and in any way that does not contradict the law (exclusive right to work), including by the methods specified in clause 2 of this article . The copyright holder may dispose of the exclusive right to the work.
By virtue of paragraph 3 of Article 1252 of the Code, in cases provided for by law for certain types of results of intellectual activity or means of individualization, in case of violation of the exclusive right, the right holder, instead of indemnification, is entitled to demand compensation from the violator for violation of this right. Compensation is subject to recovery upon proving the fact of the offense. In this case, the right holder who has applied for the protection of the right is exempted from proving the amount of losses caused to him.
The amount of compensation is determined by the court within the limits established by the same Code, depending on the nature of the violation and other circumstances of the case, taking into account the requirements of reasonableness and justice.
The copyright holder has the right to demand compensation from the violator for each case of unlawful use of the result of intellectual activity or means of individualization or for the committed offense as a whole.
In accordance with the article, in cases of violation of the exclusive right to a work, the author or another copyright holder, along with other applicable methods of protection and measures of liability established by this Code (articles 1250, 1252 and 1253), is entitled in accordance with paragraph 3 of article 1252 of the same Code at his option from the violator, instead of compensation for losses, compensation: in the amount of ten thousand rubles to five million rubles, determined at the discretion of the court; twice the cost of copies of the work or twice the cost of the right to use the work, determined on the basis of the price, which under comparable circumstances is usually charged for the lawful use of the work.
According to the legal position set out in paragraph 14 of the decision of the Plenum of the Supreme Court of the Russian Federation of June 19, 2006 No. 15 “On issues that arose in courts when considering civil cases related to the application of copyright law and related rights”, when resolving the issue of which side should prove the circumstances relevant to the case for the protection of copyright or related rights, the court must take into account that the defendant must prove compliance with the requirements of the law when using works and (or ) objects of related rights. The plaintiff must confirm the fact that he holds copyright and (or) related rights or the right to protect them, as well as the fact that the defendant has used these rights.
In accordance with paragraph 3 of the article, the exclusive right to the result of intellectual activity created by creative work initially arises from its author. This right may be transferred by the author to another person under the contract, and may also be transferred to other persons on other grounds established by law.
In support of claims, the plaintiff indicated that the defendant, through his website (www.mkkit.ru), sells confectionery products (cakes) in the form of a Tatty Teddy character (cake “D-307”), thereby violating the plaintiff's exclusive right to the character.
In support of the fact that the plaintiff has copyright on this character, an apostilled affidavit with notarized translation is presented in the case materials.
Refusing to satisfy the claim, the trial court proceeded from the fact that the plaintiff has not proved the exclusive right to the character of the teddy bear “Tatty Teddy”. The evidence does not disclose the transfer of exclusive rights to copyright.
Examining the contents of the above affidavit, the court found that, according to this document, the company's financial director John Anthony Willis officially took the oath and stated that the company is the sole worldwide owner of all copyrights that apply to all subsequent drawings, illustrations, toys, souvenirs and characters Me To You Bear (gray teddy bear with a blue nose and a patch). The company owns and controls all exclusive rights to drawings, illustrations, toys, souvenirs and characters of Mi Tu Yu around the world, regardless of size, clothing, background, pose, form of expression, etc.
The court indicated that Russian law does not provide for such a document as affidavit, and therefore qualified this evidence as inadmissible on the basis of an article of the Arbitration Procedure Code of the Russian Federation.
It was also established by the court of first instance that the plaintiff did not submit an agreement on the alienation of exclusive rights or a license agreement with an artist or other person who, through his creative work, created an image of the character of a bear cub, Me To You Bear.
In addition, the court indicated that the plaintiff did not refer in the statement of claim to the norms of foreign and / or international law governing the procedure for the emergence, transfer, protection of copyright and exclusive rights in the UK (company’s country of origin).
The court of appeal, in accordance with part 1 of the article of the Arbitration Procedure Code of the Russian Federation, re-examined the case, confirmed the correctness of the conclusions of the trial court.
The court of cassation considers that the courts of first instance and appeal have correctly determined the nature of the disputed relationship, the range of circumstances that are relevant to the resolution of the dispute and should be investigated, verified and established in the case, the laws and other regulations that should be applied according to the present case, assessed all the evidence in the case in compliance with the requirements of the arbitration procedural law.
The plaintiff’s argument cited in the complaint about the illegality of the court’s conclusion about the inadmissibility of affidavit and, accordingly, the unfounded conclusion that there is no evidence of the plaintiff’s exclusive right to a character cannot be taken into account.
From the content of the contested judicial acts it is seen that the reason for the refusal to satisfy the claim was not only the conclusion of the courts on the inadmissibility of affidavit as evidence in the Russian lawsuit, but also the plaintiff's failure to submit an agreement on the alienation of the exclusive right or a license agreement with an artist or other person who is his creative hardly created a character image.
Based on such circumstances, the courts, determining in accordance with their powers the subject of proof and the range of evidence to be submitted by the parties, the sufficiency of the evidence presented, came to the conclusion that the plaintiff had no exclusive right to the disputed character.
The cassation appeal applicant’s reference to paragraph 42 of the joint ruling of the Plenum of the Supreme Court and the Supreme Arbitration Court of the Russian Federation dated March 26, 2009 No. 5/29 “On some issues arising in connection with the enforcement of part four of the Civil Code of the Russian Federation,” the cassation court considers unreasonable , since in the present case affidavit does not contain a reference to the author of the character, which can only be an individual, but only to a company that is a legal entity.
In view of the above, the arguments of the cassation appeal, which are reduced to disagreement with the conclusions of the courts of the first and appeal instances regarding the established circumstances of the dispute, are subject to rejection by the court of cassation, since they are aimed at their reassessment, which by virtue of the article of the Arbitration Procedure Code of the Russian Federation is not allowed in the court of cassation.
Since the courts of the first and appeal instances examined all the evidence presented by the parties and evaluated all the arguments and objections of the persons participating in the case, established all the circumstances that need to be established for the correct resolution of the dispute, the substantive law rules have been correctly applied, the grounds for canceling or changing the decision made in the case and there is no resolution, in connection with which the cassation appeal is not subject to satisfaction.
The court of cassation does not find unconditional grounds for the cancellation of the appealed judicial acts, since it does not see any procedural violations when they are adopted, which are listed in part 4 of the article of the Arbitration Procedure Code of the Russian Federation.
In accordance with the article of the Arbitration Procedure Code of the Russian Federation, the costs of paying the state duty on the cassation appeal relate to the applicant.
