In order to improve the state regulation of the activities of carriers in the field of air transportation, the Regulation on licensing passenger transportation by air and the Regulation on licensing air cargo transportation were approved. The aforementioned Regulations shall enter into force on October 1, 2007.
These Provisions determine the procedure for licensing the transport of passengers and goods by air carried out by legal entities or individual entrepreneurs.
Licensing of transportation is carried out by the Federal Air Transport Agency.
Licensing requirements and conditions are established for the transport of passengers and goods. So, it is mandatory that the applicant has a license (licensee) certificate of the operator; compliance by the licensee with the general rules for air transportation of passengers (cargo) and the requirements for servicing passengers (consignors and consignees); the licensee's availability of aircraft on the basis of ownership or other legal basis in an amount sufficient (subject to reservation) to carry out passenger (cargo) transportation in accordance with the schedule of regular and non-scheduled air traffic formed by the licensee.
Also, the license applicant (licensee) is obliged to provide liability insurance for harm caused to the life and health of aircraft passengers, as well as for damage caused to baggage and belongings with passengers, or, accordingly, liability insurance to cargo owners (consignors) for loss, shortage or damage ( spoilage) of cargo.
The list of documents submitted by the applicant to the licensing authority is given. The license is granted for five years with the right to renew.
The admission of carriers having the appropriate licenses to perform international air transportation of passengers and (or) cargo is carried out by the Federal Air Transport Agency. The procedure for the formation, approval and publication of the schedule of regular air transportation of passengers and (or) goods carried out by licensed carriers is approved by the Ministry of Transport of Russia.
