Before talking in detail about the norm of working time (hereinafter also referred to as NRW), one should understand the basics: what it is made up of and what it affects. In this article, we analyze in detail how the norm of working hours for 2017 is calculated.

Annual challenge

To produce any type of product, including in completely different industries and manufacturing, the agricultural sector, it is necessary to use the labor skills of the relevant personnel. From receiving a kitchen stool to creating a jet plane, any product or product is released anyway with the participation of a person.

A group of specialists, a large team or an individual master in their sector of activity spends a certain amount of time working. Therefore, when planning production processes and mutual cooperation with other companies and buyers of products, the manufacturer must ahead of time calculate the working hours for each specialty involved in his enterprise. Ultimately, this affects the number of employees who can be accepted into the organization.

In short, the management, together with the human resources department and rationing officers, has to calculate the NRW every year.

How to determine the annual rate

First, we will reveal the term itself. As a general rule, the norm of working time is the number of hours spent on work for a calendar period. Usually. Take as a basis, 40 hours a week.

Today it is calculated on the basis of the procedure that is set out in the order of the Ministry of Health and Social Development of the Russian Federation of August 13, 2009 No. 588n (hereinafter referred to as the Procedure).

According to the provisions of this normative act, the duration of a working week (at a norm of 40 working hours, and sometimes even less) is divided by the number 5 (if a person works on a 5-day schedule) and multiplied by the number of working days in a year. After that, the number of hours for which the working days have been reduced that go right before the official public holidays is taken away from the result:

  • New Year;
  • 9th May;
  • other similar holiday dates.

By law, a working day and at the same time a pre-holiday day is usually considered reduced by 1 working hour.

The norm of hours of working time for the next year should be calculated before the end of the previous year. In this case, you need to consider:

  1. The requirements of the labor legislation of the Russian Federation.
  2. Decisions of the Government of the Russian Federation, correcting working days and holidays for next year.

So, regarding the period of 2017, the Cabinet of Ministers of the Russian Federation issued a resolution of August 4, 2016 No. 756. It said that such days of rest would be postponed:

  • 01/01/2017 on 02/24/2017;
  • 01/07/2017 05/08/2017.

Number of working hours in 2017

When determining it, the following provisions should be taken into account:

  • even if the employee works 5 or 6 days a week, Sunday is considered a day off;
  • it is possible to postpone the day off for individual specialists only if the enterprise, for objective reason, is not able to stop the workflow for the weekend. That is, the staff must fulfill their duties both on Saturday and Sunday. This is evidenced by article 111 of the Labor Code;
  • in article 112 of the Labor Code of the Russian Federation there is a list of holidays during which employees have a rest.

The Labor Code also includes holidays for the holidays (from 01.01 to 01.01 inclusive). Christmas is also attributed to the holidays with the appointment of a day off.

In addition, a holiday that falls on a weekend carries such a day of rest. This principle works every year. The only exception is the first 8 days of January - New Year and Christmas. The fact is that the transfer of rest days to the New Year holidays does not automatically occur. Each year, the Government of the Russian Federation, in a separate order, instead approves the days when employees of enterprises relax and do not go to service. This moment stipulates part 5 of article 112 of the Labor Code of the Russian Federation.

According to the legislation (part 1 of article 95 of the Labor Code of the Russian Federation), the length of the working day on the eve of an official holiday should be cut by 1 hour.

All the above requirements of the Labor Code of the Russian Federation, as well as accounting for the Procedure, are the basis for calculating working time for a calendar year. Speaking specifically and in numbers, the norm of hours of working hours for 2017 will be as follows:

The average monthly NRV for 2017

Meanwhile, knowledge of the total annual time for work does not give a complete picture of working hours in each month. Full accounting requires to be aware of the average monthly working time (each month separately).

For these purposes, the number of calendar days in a month matters. It can be from 28 to 31. So, 2017 is not considered a leap year. In addition, each month has its own number of holidays and weekends. And it varies significantly. For example, in January - as much as 8 days in addition to weekends are declared non-working. But April and October in 2017 do not have non-working holidays at all.

Local features

The above figures apply to the entire Russian Federation. But in some regions their days of rest associated with local religious holidays may be declared. Namely - on the basis of Article 4 of the Law “On Freedom of Conscience and Religious Associations” dated September 26, 1997 No. 125-ФЗ.

There are also additional provisions that give the authorities of the constituent entities of the Russian Federation to make certain calendar dates public holidays for reasons other than religious. This is article 6 of the Labor Code and paragraph 8 of the letter of the Russian Ministry of Labor dated June 10, 2003 No. 1139-21.

In such cases, the estimated norm of working hours for 2017 will look different than mainly in Russia.

Local weekends have a significant feature. If they are introduced, then the region compensates all losses in incomes for itself.

Employee Category Accounting

It is necessary to calculate NRB taking into account the category of specialist and the specifics of work. So, in certain moments, the working time of the staff should be cut. Despite the fact that other employees of this company, working on the same schedule, do not receive changes in their work schedule.

How is the annual rate determined?

First of all, it is necessary to define the norm itself. The norm of working time is the total number of hours that the employee must work during a certain period of time (year, quarter, month, week).

The norm of working time for 2019 is calculated in accordance with the procedure established by order of the Ministry of Health and Social Development of the Russian Federation of August 13, 2009 No. 588n (hereinafter referred to as the Procedure). According to this normative act, the length of the week (the norm is 40 hours, but sometimes it can be even less) must be divided by 5 and multiplied by the number of working days in a year (for a 5-day working week). Then, from the resulting figure, it is necessary to subtract the hours for which the working days were reduced before non-working holidays during the year (for example, before May 9, March 8, etc., working days are reduced by 1 hour).

The rates for the year are calculated before the end of the previous calendar year, taking into account the requirements of the Labor Code of the Russian Federation and the annual decisions of the Government of the Russian Federation regarding the transfer of holidays falling on Sunday or Saturday, work on which is not allowed. Moreover, the decision, according to Art. 112 of the Labor Code of the Russian Federation, must be adopted and put into effect no later than one month before the end of the calendar year.

In relation to 2019, the Decree of the Government of the Russian Federation dated 01.10.2018 No. 1163 is in force. It established that the following days of rest are carried forward:

  • January 5 - on May 2;
  • January 6 - on May 3;
  • February 23 to May 10.

  About the number of working hours in 2019

When calculating the norm of working hours for 2019, the following rules must be taken into account:

  1. Sunday is a weekend, regardless of whether employees are busy at five or six day work. Allowed only to transfer the weekend for certain categories of workers to another day, if the company for some reason cannot suspend its work on the weekend and someone is forced to work on Sunday or Saturday (Article 111 of the Labor Code of the Russian Federation).
  2. There is a list of holidays during which work is not performed (article 112 of the Labor Code of the Russian Federation is established). It includes New Year holidays from January 1 to January 8 (excluding January 7, since it is also a holiday when work is not performed - Christmas), Victory Day (May 9), etc.
  3. If the holiday falls on a weekend, then the day of rest is postponed. This rule always applies, with the exception of the period from January 1 to January 8, that is, the New Year holidays and Christmas. Transfers these days are not automatically valid and each year are separately approved by the Government of the Russian Federation in accordance with part 5 of Art. 112 of the Labor Code of the Russian Federation.
  4. The duration of work on the day before the holiday is reduced by 1 hour (part 1 of article 95 of the Labor Code of the Russian Federation).

Based on these requirements of the code and taking into account the Procedure, the norm for the year is calculated. Specifically, the general norm of working hours for 2019 is:

  • for a week at 40 hours - 1970 working hours;
  • for a week at 36 hours - 1772.4 hours;
  • for a week at 24 hours - 1179.6 hours.

  Monthly average hours worked in 2019

The total number of hours says little about how work is done on a monthly basis. That is why for full accounting, you need to know how many hours of work per month. At the same time, it is important to consider both the number of days in a month - from 31 in some months of the year to 28 in February (2019 is a non-leap year), and the number of holidays and weekends falling on a particular month. The amount of this can vary greatly. In particular, in January there are many additional non-working days - this will lead to the fact that those employed on a five-day holiday will have a lot of rest, and in April or October there will be no non-working holidays at all.

Do not know your rights?

Accordingly, for planning working time, such a quantity as the number of working hours on average per month can be used. To do this, you can use the above data on the total annual duration of labor time in hours.

To find out the average monthly number, you need to divide this number by 12 (the number of calendar months in a year). As a result, we get the following:

  • for the 40-hour week - 164.16 hours;
  • for a week at 36 hours - 147.7 hours;
  • for a week from 24 hours - 98.3 hours.

  Other time standards for 2019 in Russia

Also, in the work of accounting or personnel services at the enterprise, other working hours for 2019 may be required. Here are the basic details for a 40-hour week:

  • total days when work is carried out - 247;
  • weekends and holidays - 118.

Wherein:

  • in the I quarter - 57 working days, 454 hours;
  • in the II quarter - 59 days, 469 hours;
  • in the III quarter - 66 days, 528 hours;
  • in the IV quarter - 65 days, 519 hours.

The above data relate to Russia as a whole, but it must be remembered that local non-working holidays are also allowed in the regions. In particular, Art. 4 Federal Law “On Freedom of Conscience and Religious Associations” dated September 26, 1997 No. 125-ФЗ allows local authorities in the regions to do this at the request of religious organizations. Additionally, Art. 6 of the Labor Code of the Russian Federation and paragraph 8 of the letter of the Ministry of Labor of the Russian Federation dated 10.06.2003 No. 1139-21 allow local authorities to introduce days off for other reasons. The only limitation here is that all related revenue losses or increased budget expenditures must be compensated for by the region in which such a decision was made.

In addition, when calculating the rate of hours, you must not forget that it still depends on the category of employee. In some cases, the duration of work - both for a week and for a day or a shift - should be reduced, even if the usual procedure applies to all other employees of the same organization (i.e. 5 days, each of which has 8 working hours, total - 40). In particular, Art. 92 of the Labor Code of the Russian Federation indicates that for workers with disabilities of the first 2 groups a week cannot be more than 35 hours, and for workers in hazardous work of 3 or 4 degrees - no more than 36 hours. Also Art. 94 indicates that underage employees should not work more than prescribed by law (7 hours a day, if 16 has not yet turned 5 - 5). All this should be taken into account when calculating the norm for the enterprise and its further application.

  Production calendar for planning and recording working hours for 2019

Quite often, all information relating to working hours, holidays and weekends is drawn up in the form of a production calendar. Unlike the Labor Code of the Russian Federation or the aforementioned Procedure, such a calendar does not have the force of a normative act and is not officially approved, but is very convenient for use, therefore it is often used in practice. In particular, it can be used by accounting (for example, to calculate paid days for sick leave) or personnel services (for example, for planning and scheduling vacations).

For self-preparation, it’s enough to take a regular calendar with the numbers, months and days of the week and mark it in accordance with the law and the procedure for transferring weekends established by the Government of the Russian Federation. If desired, the calendar can even indicate the duration in working hours of each day of the year.

2017

In accordance with the Procedure, approved. By order of the Ministry of Health and Social Development of Russia dated 13.08.2009 No. 588n, the working hours are calculated depending on the established working hours per week according to the estimated schedule of a five-day working week with two days off on Saturday and Sunday based on the duration of the daily work (shift). So, with a 40-hour work week, the norm of working hours is 8 hours, with a work week of 36 hours it will be 7.2 hours, with a 24-hour work week it is 4.8 hours.

In accordance with Part 1 of Article 95 of the Labor Code of the Russian Federation, the duration of a working day or shift immediately preceding a non-working holiday is reduced by one hour. In 2017, employees will work one hour less on February 22, March 7, November 3.

The norm of working hours calculated in the indicated order applies to all modes of work and rest.

Weekend transfers in 2018

In 2017, in accordance with the Decree of the Government of the Russian Federation "On the transfer of days off in 2017", the following days off were postponed:

Therefore, taking into account the transfer of days off in 2017, the “New Year holidays” for employees will last 8 days - from January 1 to January 8, 2017. The Russians will also have long weekends in February (February 23 - 26).

In April - May 2017, workers will rest from April 29 to May 1 in connection with the celebration of the Spring and Labor Day, and also from May 6 to 9 in connection with the celebration of Victory Day.

In June, the rest period in connection with the celebration of the Day of Russia will last 3 days (June 10 - 12), and in November in connection with the celebration of the Day of National Unity - from November 4 to 6, 2017.

The Labor Code of the Russian Federation established that if the weekend and non-working holidays coincide, the day off is postponed to the next day after the holiday. Thus, in 2017 the weekend is postponed:

  • from Saturday November 4 to Monday November 6.

The exception is weekends coinciding with non-working holidays of January. In accordance with Art. 112 of the Labor Code of the Russian Federation, the Government of the Russian Federation has the right to transfer two days off from the number of days off coinciding with non-working January holidays to other days in the next calendar year. Decree of the Government of the Russian Federation dated 04.08.2016 No. 756 provides for the transfer of days off:

  • from sunday 1 january on friday 24 february;
  • from Saturday January 7 to Monday May 8.

In accordance with the “Procedure for calculating the norm of working hours for certain calendar periods of time (month, quarter, year) depending on the established duration of working time per week”, approved by order of the Ministry of Health and Social Development of Russia dated 13.08.09 No. 588n, this norm is calculated according to the five-day settlement schedule working week with two days off on Saturday and Sunday, based on the duration of the daily work (shift):

  • at 40-hour workweek - 8 hours;
  • at a 36-hour working week - 7.2 hours;
  • with a 24-hour work week - 4.8 hours.

The duration of a working day or shift immediately preceding a non-working holiday is reduced by one hour. In 2017, such pre-holiday working days are:

  • February 22;
  • March 7;
  • the 3rd of November.

The norm of working hours calculated in the indicated order applies to all modes of work and rest.

An example of calculating the norm of working time in November 2017 with a five-day working week with two days off (initial data: 21 working days, November 3, the working day is reduced by 1 hour):

  • calculation at 40-hour work week:
    (8 hours x 21 days) - 1 hour \u003d 167 hours;

  • (7.2 hours x 21 days) - 1 hour \u003d 150.2 hours;

  • (4.8 hours x 21 days) - 1 hour \u003d 99.8 hours.

In 2017, 247 business days, including 3 business days, were reduced by one hour. Calculation of the norm of working time for 2017 with a five-day working week with two days off:

  • at 40 hour workweek:
    (8 hours x 247 days - 3 hours) \u003d 1973 hours;

What are the norms of working hours for 2017

The employer pays for the work of his employee according to the hours worked (Article 91 of the Labor Code of the Russian Federation). Working time is the number of hours that an employee spent on performing his labor duties, according to the employment contract and the internal rules of the day.

Accordingly, the norms of working hours in 2017 are a set of hours that an employee must work for a certain calendar period.

How to calculate working hours

The norms of working hours for 2017 are calculated on the basis of the approved transfer of days off (resolution dated 04.08.2016 No. 756).

The rules for calculating the norm are approved by order of the Ministry of Health and Social Development of Russia of 08.13.2009 No. 588n. According to these rules, the norm is calculated based on the schedule of a five-day working week with two days off (Saturday and Sunday).

When calculating working time, it is necessary to take into account the requirement to reduce the length of the working day (shift) immediately preceding a non-working holiday by 1 hour.

For convenience, the formula by which the working hours for 2017 are calculated is presented in the figure below.

How to apply the above formula, we show an example. We will calculate   working hours for 2017 with a 40-hour work week.

Example. In February 2017, the Government of the Russian Federation added one day off - February 24. February 22, the working day is reduced by one hour.

In February 2017, with a 40-hour workweek, the norm of working hours is 143 hours (40 hours: 5 business days × 18 business days - 1 hour).

Reduced working hours

  • employees under the age of 16 - no more than 24 hours a week,
  • workers aged 16 to 18 years - not more than 35 hours a week. This also includes people with disabilities of groups 1 and 2,
  • employees aged 16 to 18 who work and study at the same time - no more than 17.5 hours a week,
  • employees whose working conditions are classified as harmful or dangerous working conditions - not more than 36 hours a week. With all this, such employees are shortened their working week under the following conditions:
  1. harmful and dangerous conditions are confirmed by certification of workplaces,
  2. if harmful working conditions are assigned to 3 or 4 degrees.

The duration of the individual employee is fixed in the employment contract, of course based on article 92 of the Labor Code of the Russian Federation.
